This website is operated by Boho & Mala Jewellery (Fabbris Holdings Pty Ltd, ACN 661 213 841). Throughout the site, “we”, “us” and “our” refer to Boho & Mala Jewellery. By visiting our site or purchasing from us, you agree to these terms and to the policies linked from them.

1. Online store terms

You must be at least 18, or have the consent of a parent or guardian, to buy from this site. You agree not to use our site or products for any unlawful purpose, and not to reproduce, copy, sell or exploit any part of the site or its content without our written permission. All content on this site, including images, designs, product names and text, belongs to Boho & Mala Jewellery.

2. Products and pricing

All prices are in Australian dollars and include GST. Prices and products may change without notice. We do our best to display colours and sizes accurately, but screens vary, and natural gemstones and freshwater pearls vary in colour, shape and size, which is part of their character. We may limit quantities or refuse an order at our discretion, including orders that appear to be placed by resellers, other than approved Boho & Mala wholesale accounts.

3. Orders and payment

An order is accepted when we send your order confirmation. You agree to provide accurate, current and complete purchase and account information. If a product is unavailable after you order, we'll contact you to offer an alternative or a full refund. If we find a pricing or description error, we may cancel the order and refund you in full.

4. Shipping, returns and warranty

Delivery times, costs and click & collect are set out in our Shipping & Delivery policy. Change-of-mind returns, faulty items and warranty are set out in our Returns & Warranty policy.

5. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.

6. Discounts and gift cards

Discount codes can't be combined unless we say otherwise, and can't be applied after an order is placed. Gift cards are valid for 3 years from purchase, can't be exchanged for cash and can be used online or in store as stated at purchase.

7. Wholesale

Wholesale orders are subject to our separate wholesale terms, which are provided when a stockist account is approved.

8. Jewellery care and safety

Please follow the care instructions on each product page. Our jewellery is not designed for children under 3 and may contain small parts. Gemstone and crystal meanings described on this site are traditional beliefs and are not medical advice.

9. Liability

To the extent permitted by law, we are not liable for indirect or consequential loss arising from your use of this site or our products. This does not limit any rights you have under the Australian Consumer Law.

10. Privacy, reviews and content you send us

Your personal information is handled under our Privacy Policy. If you send us a review, photo or comment, you allow us to publish and use it in connection with our business, and you confirm it is your own and not offensive or unlawful.

11. Third-party links and tools

Our site may link to third-party websites or use third-party tools. We are not responsible for their content or practices.

12. Changes and governing law

We may update these terms by posting the new version here; continued use of the site means you accept the changes. These terms are governed by the laws of Western Australia, Australia.
